The Supreme Court on Thursday has ruled on Petitions of Peter Obi and labour party against the victory of President Bola Tinubu.
On the 25% of FCT required to wins Presidential election, the court ruled that FCT Citizens Doesn’t enjoy special privileges ahead of other States.
The apex court also ruled that INEC’s failure to electronically transmit the result of the 2023 presidential election to iRev did not affect the result of the election won by Bola Tinubu.
Justice Inyang said: “The IREV portal is not a collation system… where the IREV portal fails, it does not stop the collation of results.”
Justice Iyang Okoro agreed with the lower court that iREV is not a collation centre and that there is an elaborate arrangement to ensure that copies of results are available.
“The unavailability of the iREV cannot be a ground for the nullification of the election,”
“The failure to transmit results to irev did not affect the results of the election,” said the apex court
The judge then dismissed the petitions.
The Presidential Election Petition Court had ruled that that non transmission of results electronically is not a basis to challenge an election.
