The Supreme Court on Thursday has ruled on the motion by the presidential candidate of Peoples Democratic Party, PDP to provide fresh evidence against the victory of President Bola Tinubu.
Atiku and the PDP had asked the apex court to accept the fresh evidence in the form of documents obtained from the Chicago State University on President Bola Tinubu’s academic records.
But the judge said in determining the merit of the motion, the court will first ascertain whether the nation’s law, as at today, allows the court to accept this fresh evidence at this stage.
Delivering a judgement on Thursday, the apex court ruled that the application to file fresh evidence by the Peoples Democratic Party (PDP) candidate, Atiku Abubakar in the appeal challenging President Bola Tinubu’s victory violates the provisions of the Electoral Act.
The court held that the Electoral Act prohibits the amendment of an election petition in such a manner.
Justice John Okoro in a ruling held that the Supreme Court cannot activate section 22 of the Supreme Court Act after 180 days has lapsed at the lower court.
The judge ruled that the apex court cannot accept new evidence not presented at the Presidential Election Tribunal or at the lower court.
